South African law no longer draws a distinction between legitimate and illegitimate children in terms of inheritance.

As such, in the event of a parent passing away intestate (i.e. without a valid will) children born outside of the bonds of marriage will be entitled to the same rights to inherit from the parent’s estate as those born from the marriage of the deceased parent.
